1.1. All intellectual property rights, including trademarks, logos, designs, and written content on Water Service Elite Inc.’s website and materials, are the exclusive property of Water Service Elite Inc. or its respective owners.
1.2. Water Service Elite Inc. reserves the right to modify product availability, pricing, and these terms and conditions at any time without prior notice.
1.3. If a listed item becomes unavailable or backordered, we will make reasonable efforts to provide a compatible substitute or upgraded version. Customers will be notified if no alternative is available.

2. Pricing and Payment Terms

2.1. Pricing Inaccuracies:

• If an incorrect price is listed on Water Service Elite Inc.’s website, we reserve the right to cancel any order placed for that item and will notify the customer of this action.

2.2. Payment Terms:

• Full payment is required before service completion unless otherwise agreed in writing.
• Late payments will accrue interest at a rate of 2% per month from the due date until paid in full.
• Payment disputes must be reported in writing within 7 days of invoice receipt.

3. Visual Representations

3.1. We make every effort to provide accurate images of our products. However, these images are for reference only and may not fully reflect the actual item.

4. General Terms and Conditions of Sale

4.1. Scope:

These Terms and Conditions apply to all sales of goods and/or services provided by Water Service Elite Inc. (“Seller”) to the customer (“Buyer”). These conditions remain in effect until replaced by updated terms.

4.2. Purchase Orders, Estimates, and Acceptance

• A Purchase Order (PO), approved estimate, payment of an invoice, or written acceptance via email shall constitute a binding contract between the Buyer and Water Service Elite Inc.
• Any modifications or cancellations require written consent from Water Service Elite Inc. and may be subject to additional charges.
• Verbal agreements or unsigned estimates do not constitute a binding contract unless followed by email confirmation or payment.

5. Termination and Cancellation

5.1. Orders may be canceled in writing prior to service commencement. However, cancellation fees may apply depending on the stage of the project.
5.2. For custom-made goods, cancellation may result in a non-refundable charge if work has already begun.

6. Delivery and Shipping

6.1. Shipping Terms:

• Shipping and delivery estimates are provided as a guideline and are not guaranteed.
• Water Service Elite Inc. is not responsible for delays due to shipping carriers, supply chain issues, or force majeure events (natural disasters, strikes, governmental restrictions, etc.).

6.2. Ownership & Risk:

• Risk of loss or damage passes to the Buyer upon delivery.
• Ownership of goods remains with Water Service Elite Inc. until full payment is received.

7. Returns and Warranty

7.1. Return Policy:

• Returns must be requested within 3 days of receipt and require prior authorization.
• Custom-made or special-order items are non-refundable.
• The buyer is responsible for return shipping costs unless the item was defective.

7.3. Non-Returnable and Non-Cancellable Products Due to Sanitation Regulations

For sanitation and public health safety reasons, once a water treatment system, filtration unit, or any related component has been installed and water has passed through it, the sale is final and non-refundable.

• No returns, exchanges, or cancellations will be accepted for any system that has been used, as it cannot be resold or reused under federal and state sanitation laws.
• This policy is in compliance with California health and safety codes, industry sanitation regulations, and water treatment standards, which prohibit the resale or reuse of systems that have been exposed to water.
• Customers acknowledge and agree to this strict no-return policy upon approving an estimate, making a payment, or accepting delivery and installation of the system.

8. Limitation of Liability

8.1. General Liability:

• Water Service Elite Inc. is not liable for any indirect, incidental, or consequential damages arising from product use, service delays, or contract performance.
• Liability is limited to the cost of the services or products provided.

8.2. Liability for Services Performed:

• Water Service Elite Inc. shall not be liable for damages caused by unforeseen circumstances, acts of nature, or pre-existing plumbing/equipment issues not disclosed by the Buyer.

9. Compliance with Local Laws

9.1. All services provided by Water Service Elite Inc. comply with applicable federal, state, and local laws, including California Contractors State License Board (CSLB) regulations.
9.2. Buyer is responsible for obtaining any necessary permits, approvals, or inspections required by local authorities unless explicitly included in the service contract.

10. Dispute Resolution

10.1. Any disputes shall first be attempted to be resolved through negotiation.
10.2. If unresolved, disputes shall be settled through arbitration in Orange County, California in accordance with the American Arbitration Association (AAA) rules.
10.3. In the event of litigation, the prevailing party shall be entitled to reasonable attorney’s fees and court costs.
